Dispenser:
New Mexico is a quota state and has a limited number of Dispenser type Licenses. Some examples of businesses that need a Dispenser License are: Bars, full service Restaurants that intend to serve beer, wine and spirits and/or have a bar, Convenience Stores, Grocery Stores, Wine Bars, Gift Shops, Nightclubs, Package Liquor Stores, Non-Resident, Common Carrier.
Licenses of this type are bought and sold, transferred to new locations or leased, with the prior approval of the Alcoholic Beverage Control Division. You must obtain information on licenses available for sale or lease on your own or contact a Liquor License Attorney or a Broker. ABC does not provide this type of information. Non-Dispenser:
SMALL BREWER, WINEGROWER, CRAFT DISTILLER, Bottler, WHOLESALER, MANUFACTURER, GOVERNMENTAL, PUBLIC SERVICE, and NON-PROFIT CLUBS
To Manufacture/produce Hard Cider you will need a Winegrower License.
To Manufacture/produce Komucha you will need a Small Brewer License.
RESTAURANT (Beer and Wine):
Restaurants that want a Beer and Wine License must be a full service Restaurant with staff to serve both food and beer/wine.

A Resident Agent is a person who is a New Mexico resident, who is 21 years of age or older, is not a felon, who may accept service of process and who may bind the applicant in matters relating to liquor sales and operations. The Resident Agent must be alcohol server certified and must pass a background check. An existing Officer must appoint the Resident Agent and that Officer/Agent will sign the top portion of the Designation of Resident Agent Application and have the signature notarized. The appointed Resident Agent will sign the bottom portion and have his signature notarized as well.
Submit:
1. Page 5 - Designation of Resident Agent form, completed and notarized in both places
2. $50.00 Fee; no fee imposed for non-profit clubs
3. Page 6 - Personal Data Affidavit for the new appointee
Change in Officers:
ALL HOLDERS OF A LIQUOR LICENSE who have had a CHANGE OF OFFICERS, such as removal/replacement of officers or directors, must complete an Application. (Change of Officers for non-profit Clubs, see Club License section.) Instructions are as follows: APPLICATION FOR CHANGE OF OFFICERS
1. Change of Officers Application, Fee $200: Must contain current Officer/Director information. Make sure the application is completed and signed before a notary public and that the Limited Liability Company /Corporation /Partnership page has been included.
2. If you are a corporation, you must submit a copy of the Corporate Report that was submitted to the Secretary of State (SOS) listing the new officers. Officers submitted to ABC must match what is on file with the Secretary of State. You may check the officers on file with SOS online at: http://www.sos.state.nm.us/Business_Services/ or contact them at (505) 827-4511 or 800-477-3632 or email: corporations@state.nm.us. Corporation must be in Good Standing with the SOS Business Services Division (SOSCBS).
3. MINUTES: You must submit a signed copy of the Minutes highlighting the relevant section, verifying the election of the new Officers/Directors when you submit your Application.
4. If the Resident Agent is changing, submit the completed Designated of Resident Agent form and the fee of $50. See instructions above.
